CONTEST RULES

(the “Official Rules”)

ALCON CANADA INC. and AMBER MAC FACEBOOK CONTEST

(the “Contest”)

These Official Rules govern the Contest.  By participating or attempting to participate in the Contest, you will be deemed to have agreed to these Official Rules and to be bound by the decisions of the Sponsor, which decisions are final, binding, and conclusive.

Entry Period: This contest is sponsored by Alcon Canada Inc. (“Sponsor” or “Alcon”) and is open between 9 am ET on Thursday, November 8 and 11:59 pm ET on Sunday, November 25, 2018 (the “Entry Period”). All times referenced in these Official Rules are Eastern Standard Time.

Who Can Enter: Contest open only to residents of Canada, excluding residents of Quebec, who have reached the age of majority at the time of entry.  Employees, representatives or agents of Alcon and AmberMac Media Inc., and their parent, affiliated or related companies, subsidiaries, divisions and all their advertising, media buying and promotional agencies, are ineligible, as well as members of the immediate family of, or persons domiciled with, any of those described above. Immediate family means parents, siblings, children or spouse.

How to Enter: No purchase necessary.  Participants must have internet access and a valid Facebook account to enter the Contest.  If you do not have a Facebook account, you can obtain one for free at facebook.com.  To receive one (1) entry into the Contest, log into your Facebook account and visit facebook.com/ambermac during the Entry Period to find Amber Mac’s 60 second video on how she “Sees It All” with ALCON®DAILIES®  and then post your answer to the question, “What will I do when I can “See it all” with ALCON®DAILIES®?”.

Comments must not infringe upon any person’s personal or proprietary rights, or be offensive, obscene, libelous, threatening, harassing, derogatory or otherwise in bad taste or inappropriate, and may not contain any personal information.

Conditions of Entry: Limit one (1) entry per person.  By way of illustration, if two or more otherwise eligible individuals share a single account, only one of them may enter the Contest; and, if an eligible individual has multiple accounts, he or she may only enter the Contest once in respect of only one of those accounts.  Anyone found to be using multiple accounts to participate will be disqualified.

All entries are subject to verification. In the event of a dispute as to the identity of an entrant, the entrant will be deemed to be the authorized account holder of the Facebook account used to enter. “Authorized account holder” is the person assigned to a Facebook account by Facebook.

Entries may be rejected and removed from Alcon’s Facebook Page if, in Sponsor’s sole discretion:

  • (i) you attempt to enter the Contest in a fashion not authorized by these Official Rules;
  • (ii) your entry contains false or misleading information, or is late, falsified, illegible, damaged or incomplete or otherwise irregular;
  • (ii) your entry is submitted using robotic, automated, programmed, or other illicit means; or
  • (iv) your entry is not in compliance with these Official Rules.

Prize: There is one (1) prize available to be won.  The prize consists of one year’s worth of ALCON DAILIES lenses, which will be provided to the winner by an eye care professional (if required, Alcon will arrange for an eye examination by an eye care professional). Approximate Retail Value (“ARV”) of lenses is CAD $800 (for an annual supply of ALCON®DAILIES®contact lenses) & up to $250 to cover a comprehensive eye exam including contact lens fitting if required for a total of $1,050.

The prize may be substituted, in whole or in part, with a prize or prize component of equal or greater value if the prize or prize component cannot be awarded for any reason.  Prize must be accepted as awarded, may not be refunded or transferred, and is not convertible to cash.

How Potential Winner Will be Selected and Contacted: Potential winner will be selected in a  by Alcon Sponsor occurring on or about Wednesday, November 28 at Noon ETfrom among all eligible entries received during the Entry Period in accordance with these Official Rules.  If a selected entry does not comply with these Official Rules, including if he/she does not correctly answer the skill-testing question, he/she will not be awarded the prize.  Your chances of winning a prize depend on the number of eligible entries received during the Entry Period. The best entry will be chosen solely by Sponsor.

Sponsor will attempt to contact potential winner via direct message or other means on Facebook.  Prior to being declared a winner, the potential winner must first:

  • (i) correctly answer, unaided, a mathematical skill-testing question;
  • (ii) sign and return, within the designated time period, a release of liability and consent to publicity form, and any other documentation required (the “Contest Release”);
  • (iii) provide proof of identification to confirm eligibility or to claim a prize, or provide proof that you are the authorized account holder of any account associated with the selected entry, and
  • (iv) otherwise be in compliance with these Official Rules.

If a potential winner cannot be contacted within seven (7) days of the Sponsor’s first attempt at contact, fails to correctly answer the skill-testing question, fails to sign and return any required Contest Release within the time specified on such releases, and/or otherwise is not in compliance with these Official Rules, he/she will be disqualified and forfeits the prize.  In the event a potential winner is disqualified or not eligible, he/she shall not be awarded the prize, and another entry may be selected in accordance with these Official Rules, or the prize may not be awarded, and Sponsor shall be fully and completely released and discharged from any liability or responsibility in this regard.

Instructions on how to claim the prize will be mailed to confirmed winner within two (2) weeks from date of winner confirmation.

Collection of Personal Information: By entering the Contest, you consent to Alcon’s collection, use and disclosure of your personal information in accordance with the Privacy Policy, available at https://www.alcon.ca/en/content/privacy-policy  (the “Alcon Privacy Policy”), for purposes of administering the Contest as described in these Official Rules.

General Conditions and Limitation on Liability: Released Parties (as defined below) are not responsible for lost, late, incomplete, damaged, inaccurate, stolen, delayed, misdirected, or undelivered entries, likes, comments, posts or correspondence, incorrect, changed or non-functioning Facebook accounts; errors of any kind whether human, mechanical, electronic, typographical, printing or otherwise relating to or in connection with the Contest, including, without limitation, errors which may occur in connection with the administration of the Contest, the processing of entries, likes, comments or posts, or in any Contest-related materials. Released Parties are not responsible for injury or damage to participants’ or to any other person’s person or property related to or resulting from participating in this Contest or use of the prize or downloading materials from or use of any website. Proof of entry will not be deemed to be proof of receipt. Persons who tamper with or abuse any aspect of the Contest, as solely determined by Sponsor, will be disqualified. Sponsor reserves the right at its sole discretion to cancel, suspend, modify or terminate the Contest and Contest Rules for any reason and without notice.

By participating in this Contest, you agree (i) to be bound by these Official Rules and the decisions of Sponsor which are final and binding, and (ii) and forever discharge the Sponsor, AmberMac Media Inc, their respective parents, affiliates, and subsidiaries, Amber Mac, any other person associated with the Contest, and all of their respective directors, officers, employees, agents, representatives, licensees, successors and assigns (collectively, the “Released Parties”), and agree to indemnify and hold harmless each of the Released Parties, from and against any and all claims, damages or liability, including any costs or losses related to personal injury, death, damage to or loss or destruction of property, arising out of, or in any way related to, (a) your participation in the Contest, (b) the awarding, receipt, possession, use or misuse of any prize, in whole or in part, or (c) any breach of these Official Rules.

Contest is subject to all applicable laws. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participants and the Sponsor in connection with this Contest, shall be governed by, and construed in accordance with, the laws applicable in the province of Ontario.

Any questions, comments or complaints regarding the Contest must be directed to the Sponsor and not to Facebook.
